Acceptance of Terms

By creating an account or using Xaraash (the 'Platform'), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

Xaraash is a peer-to-peer classifieds marketplace that connects buyers and sellers of physical goods. We do not buy or sell goods ourselves and are not a party to any transaction between users.

Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into contracts.

Xaraash reserves the right to suspend or terminate accounts that violate these Terms at any time and without prior notice.

Listings and Content

You are solely responsible for the accuracy, legality, and completeness of any listing you post. Listings must describe real, physical items you own and intend to sell.

The following are strictly prohibited: counterfeit or stolen goods, weapons and ammunition, controlled substances, adult content, items subject to trade sanctions, and any item whose sale is illegal under applicable law.

Xaraash reserves the right to remove any listing at any time, with or without notice, that we determine in our sole discretion violates these Terms or applicable law.

Seller Commissions

Xaraash charges sellers a 1% commission on completed transactions. This commission is due within 48 hours of a sale being confirmed.

Failure to pay an outstanding commission may result in a temporary restriction on creating new listings until the balance is settled.

Commission rates are subject to change with 30 days' notice to affected sellers.

Payments

Transactions between buyers and sellers are conducted directly. Xaraash supports EVC Plus, eDahab, ZAAD, and Sahal mobile payment networks as a convenience but does not hold, transfer, or escrow funds on behalf of users.

Xaraash is not responsible for payment disputes between buyers and sellers. We strongly encourage users to verify all details before completing a transaction.

Prohibited Conduct

You agree not to: impersonate another person, engage in fraudulent or deceptive practices, harvest user data, post spam, circumvent security features, or use the Platform to facilitate illegal activity.

You also agree not to attempt to contact buyers or sellers outside the Platform to avoid commissions or fees.

Intellectual Property

All content you upload to Xaraash (photos, descriptions, etc.) remains your property. By posting, you grant Xaraash a non-exclusive, royalty-free licence to display, reproduce, and distribute your content solely to operate the Platform.

The Xaraash name, logo, and design are trademarks of Xaraash. You may not use them without prior written permission.

Disclaimers and Limitation of Liability

The Platform is provided 'as is' without warranties of any kind, express or implied. Xaraash does not guarantee the accuracy of any listing, the conduct of any user, or the outcome of any transaction.

To the maximum extent permitted by law, Xaraash's liability for any claim arising from use of the Platform is limited to the amount of commission fees you paid to us in the three months preceding the claim.

Termination

You may delete your account at any time by contacting support@xaraash.com. We will remove your personal data within 30 days, subject to legal retention obligations.

Xaraash may terminate or suspend your account immediately for any violation of these Terms.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.

Governing Law

These Terms are governed by the laws of the Federal Republic of Somalia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mogadishu.
